Your Rights
Once the unionization drive is underway, the BC Labour Code sets out your rights... and Teamsters 213 will be there to make sure those rights are protected.
Here is a quick glimpse at how your rights are protected under the Code:
- You are free to be a member of a trade union, just as your employer is able to be part of an employer's organization. Section 4 (1)
- The employer cannot refuse to employ anyone... or dismiss anyone... or discriminate against anyone because that person is pursuing their rights under the Code - in this case to join a union. Section 5 (1)
- But the code also goes further by protecting people who are encouraging their co-workers to become trade union members. In the Code's own language, employers are not able to "discharge, suspend, transfer, lay off or otherwise discipline" and employee except for proper cause during the union drive. Section 6 (3)
If you find the employer is discriminating against you during this organization drive, contact us immediately and we will make sure our lawyers and other resources are there for you.
And we encourage you to visit the full BC Labour Code.
